Gallery Buyer Agreement
Terms for purchasing one-of-one and limited-edition artwork from the Pixel Pull Studio Gallery
Scope note: This Agreement covers only artwork in the curated Pixel Pull Studio Gallery (Lock IDs beginning "PPS-2026-"), registered in our Registry as described below. Artwork listed by independent artists through our self-serve Artist Marketplace (Lock IDs beginning "PPS-MKT-") is governed instead by our Terms of Service and Refund Policy (Artist Marketplace sections) — note that all Marketplace sales are final.
1. PURCHASE & OWNERSHIP
When you purchase a one-of-one or limited-edition artwork ("Artwork") from the Pixel Pull Studio Gallery, you are acquiring a unique digital asset. Full ownership transfers to you upon payment completion and registration in our Registry.
Your Rights After Purchase:
- Ownership: You own the digital file. Your Lock ID and License Key are permanently unique to you.
- Encrypted Delivery: Your Artwork's master file is stored encrypted (AES-256). Your License Key is the decryption key — it is delivered to your email once, and only someone holding it can unlock and download the file. Keep your License Key safe and confidential. Anyone you share it with can download your Artwork.
- Lost License Key: If you lose your License Key, contact hello@pixelpullstudio.com from your purchase email address. After we verify you are the registered owner, we can issue a replacement key; the old key is then revoked.
- Display & Storage: You may display the Artwork privately, store it indefinitely, and manage it through the Registry.
- Transfer & Resale: You may gift, transfer, or resell the Artwork. Upon transfer, the Registry updates to reflect the new owner, and the sale becomes permanent public record.
- No Reproduction Rights: You may NOT reproduce, distribute, modify, or create derivatives of the Artwork without explicit written permission from Pixel Pull Studio or the original artist.
2. PRICING & PAYMENT
All prices are displayed in USD and exclude applicable taxes (if any). Payment is processed securely through Stripe. Your card information is never stored on our servers.
Pricing is subject to change. The price you see at checkout is the price you pay. For resales on the open market, pricing is entirely between buyer and seller.
3. REFUNDS & DIGITAL GOODS
All one-of-one artwork sales are final. Refunds are not available for purchases of unique digital art because:
- Digital goods cannot be "returned" — once downloaded and registered, the asset is yours.
- Artwork is non-fungible — no two pieces are identical, making standard refund policies inapplicable.
- You receive immediate access; the transaction is irreversible.
Only Exception:
If the Artwork file is corrupt, unreadable, or missing due to our error, we will provide a replacement file or full refund. Please contact hello@pixelpullstudio.com with proof within 7 days of purchase.
4. ARTWORK AUTHENTICITY & PROVENANCE
Each one-of-one Artwork comes with a unique Lock ID and license key registered in the Pixel Pull Studio Registry. This Registry is the permanent, public record of ownership history and provenance.
- Authenticity: Your Lock ID proves you own the official, unique version of the Artwork.
- Public Record: Registry entries (artwork name, owner, price history, Lock ID) are permanent and publicly visible. This cannot be changed or deleted.
- Verification: Any buyer can verify ownership and price history by checking the Registry.
5. INTELLECTUAL PROPERTY
Artwork copyright: The artist retains copyright to all Artwork designs, compositions, and concepts. You own the digital file itself, but not the underlying intellectual property.
Your Use is Limited To:
- Personal, non-commercial display and enjoyment
- Printing for personal use only (no commercial production)
- Storing and transferring ownership through the Registry
You May NOT:
- Reproduce or mass-produce the Artwork for commercial sale
- Create derivatives, remixes, or modifications
- License or sublicense the Artwork to others
- Use the Artwork for commercial purposes without written permission
- Remove or alter artist attribution, copyright notices, or Lock ID watermarks
6. MARKETPLACE & REGISTRY
The Pixel Pull Studio Registry allows you to track, transfer, and resell Artwork. When you list Artwork for sale or resale:
- The Registry updates to show new ownership and price.
- All price history is visible to the public for transparency.
- Transfers become part of the permanent provenance record and cannot be undone.
- You agree that all Registry data is public and immutable.
7. DISPUTE RESOLUTION
If you believe there is a problem with your Artwork or transaction:
- Email hello@pixelpullstudio.com with your order number, Lock ID, and description of the issue.
- We will respond within 2 business days.
- For file integrity issues, we offer replacement or refund (see Section 3).
- For other disputes, we reserve the right to review and make a determination in good faith.
Chargebacks: Initiating a chargeback through your payment processor will result in account termination and loss of Registry access. All disputes must be resolved directly with us via email first.
8. TAXES & COMPLIANCE
You are responsible for any taxes owed on your purchase. We may be required to collect sales tax, VAT, or other duties depending on your location. These will be added at checkout if applicable.
For resales and transfers, consult a tax professional regarding capital gains or other tax implications in your jurisdiction.
9. LIABILITY & DISCLAIMERS
ARTWORK IS PROVIDED "AS-IS" without warranties of any kind, express or implied. To the maximum extent permitted by law:
- We make no warranty that Artwork will meet your expectations or specific purposes.
- We are not liable for lost profits, indirect damages, or consequential damages from Artwork purchase or use.
- Our liability is limited to the amount you paid for the Artwork.
- Some jurisdictions do not allow liability limitations, so this may not apply to you.
10. CHANGES TO THIS AGREEMENT
We may update this Agreement at any time. Changes apply to new purchases immediately. Existing ownership is not retroactively affected, but continued use of the Registry and Gallery implies acceptance of updates.
11. JURISDICTION & GOVERNING LAW
This Agreement is governed by the laws of Tennessee, USA, without regard to conflict of law principles. Any disputes will be resolved in the state or federal courts of Tennessee.
