Artist Marketplace Agreement

PIXEL PULL STUDIO — Effective Date: July 9, 2026

This Agreement governs your participation as a self-serve seller ("Artist," "you") on the Pixel Pull Studio marketplace (the "Marketplace") — the self-service listing system available through your Artist Dashboard after creating a member account with the "Artist" role. It supplements, and does not replace, our general Terms of Service and Privacy Policy, which also apply to you.

This is separate from our curated Gallery. Artwork you list through the Marketplace is stored and identified separately (Lock IDs beginning "PPS-MKT-") from the Studio's own curated one-of-one Gallery pieces, and is not covered by the Gallery Buyer Agreement. It is also separate from our manually-reviewed artist application process — creating a Marketplace account does not involve review before your account is created, though listings themselves may be reviewed as described in Section 6.

1. Your Account & Member ID

When you register, you receive a unique Member ID (format PPS-MEM-XXXXXXXX). Keep it accessible for your records; you do not need to keep it confidential from us. Your account gives you access to your Artist Dashboard, where you can list artwork, track sales, and manage your Stripe Connect account.

You may not list artwork that:

Violation of this section may result in listing removal, account suspension, or termination, at our discretion, in addition to any other remedies available to us or to third parties.

Automated screening: Every listing is automatically screened at submission for content that violates this section. Listings that are flagged will not be published; you'll be asked to revise and resubmit. This automated check is a first pass, not a substitute for the standards in this section — content that passes the automated check but still violates this Agreement may be removed later.

4. Commission & Earnings

Pixel Pull Studio retains a commission on each completed sale, calculated as a percentage of the sale price. The rate is based on your lifetime earnings on the Marketplace and increases as your lifetime earnings grow:

Your dashboard displays your current commission rate and total lifetime earnings at all times. We may change this schedule going forward; changes apply to future sales, not sales already completed.

6. Review, Removal & Suspension

Pixel Pull Studio reserves the right to review, moderate, edit, remove, or reject any listing at any time — before or after it becomes visible to buyers — for any reason, including suspected violation of this Agreement. We may suspend or terminate your Marketplace account for policy violations, fraud, repeated chargebacks, or at our discretion. Suspension does not forfeit earnings already credited to you for completed, non-disputed sales, but may delay or pause pending payout requests during investigation.

7. Chargebacks & Fraud

If a sale of your artwork is later reversed by the buyer's bank (chargeback) or found to be fraudulent, the corresponding amount may be deducted from your available balance or future earnings. Repeated chargebacks associated with your listings, or any attempt to submit fraudulent payout requests, will result in account suspension and forfeiture of the disputed amount.

8. Taxes

You are solely responsible for reporting and paying any taxes owed on your Marketplace earnings. You are an independent seller, not an employee, agent, contractor, or partner of Pixel Pull Studio, and nothing in this Agreement creates such a relationship. Where required by applicable law, Pixel Pull Studio may issue tax reporting forms (such as IRS Form 1099-NEC or 1099-K) based on your earnings; consult a tax professional regarding your own obligations.

9. Refunds Affecting Your Sales

If a buyer is granted a refund on artwork you sold, the commission and your share of that sale will be reversed from your account. See our Refund Policy for how buyer refund requests are handled.

10. Liability & Disclaimers

THE MARKETPLACE IS PROVIDED "AS-IS." WE DO NOT GUARANTEE SALES, VISIBILITY, OR EARNINGS OF ANY KIND.

To the maximum extent permitted by law, Pixel Pull Studio is not liable for indirect, incidental, or consequential damages arising from your use of the Marketplace. Our total liability to you under this Agreement is limited to the unpaid balance owed to you at the time a claim arises.

11. Changes to This Agreement

We may update this Agreement at any time. Material changes will be posted here with a new effective date. Continued use of your Artist Dashboard after changes are posted constitutes acceptance.

12. Governing Law

This Agreement is governed by the laws of Tennessee. Any disputes will be resolved in Knox County, Tennessee courts.
